Terms of Sales :

These conditions of sale are concluded on the one hand by the company hereinafter called "Vanerra" and on the other hand, by any natural or legal person wishing to make a purchase via the website of "vanerra.com" named herein. -after “the buyer”.

Object :

These conditions of sale aim to define the contractual relations between Vanerra and the buyer and the conditions applicable to any purchase made through the vanerra.com merchant site, whether the buyer is a professional or a consumer.
The acquisition of a good or service through this site implies unreserved acceptance by the buyer of these conditions of sale.
These conditions of sale will prevail over any other general or specific conditions not expressly approved by Vanerra.
Vanerra reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

Characteristics of the goods and services offered:

The products and services offered are those which appear in the catalog published on the Vanerra site.

These products and services are offered while stocks last.
Each product is accompanied by a description established by the supplier.
The photographs in the catalog are as faithful as possible but cannot ensure perfect similarity with the product offered, particularly with regard to the colors.

Prices :

The prices appearing in the catalog are inclusive of VAT in euros, taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of the products or services.

Vanerra reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.
The prices indicated do not include order processing, transport and delivery costs as long as they take place in the geographical areas provided below.

Geographical area:

The online sale of products and services presented on the site is reserved for buyers who reside in France, the Overseas Territories or Monaco and for deliveries required in these geographical areas.

In the event of delivery of a product outside the territory of the European Union and in the French Overseas Territories, the Buyer declares itself the importer of the product and accepts that in such a case Vanerra may be physically unable to provide him with exact information on the total amount of costs relating to customs duties and formalities or import taxes applicable in the country where delivery of the product is requested.

Unless otherwise stated on the site during the order process or in the description of the products ordered, Vanerra undertakes in all cases to deliver the products within a maximum period of thirty (30) days after the conclusion of the contract with the Buyer.

Orders :

The buyer who wishes to purchase a product or service must:

– complete the identification form on which he will indicate all the requested contact details or give his customer number if he has one;

– complete the online order form giving all the references of the products or services chosen;
– validate your order after checking it;
– make payment under the conditions provided;
– confirm your order and payment.

Confirmation of the order entails acceptance of these conditions of sale, acknowledgment of having perfect knowledge of them and the waiver of taking advantage of one's own conditions of purchase or other conditions.

All the data provided and the recorded confirmation will constitute proof of the transaction. Confirmation will be worth signing and acceptance of transactions.
The seller will communicate by email confirmation of the registered order.

Withdrawal:

Buyers, non-professional individuals, benefit from a withdrawal period of fourteen days from receipt of their order to return the product to the seller for reimbursement without penalty, with the exception of initial shipping costs (at note that return costs are the responsibility of the buyer).

Payment terms :

The price is due when ordering.

Payments will be made by credit card; they will be carried out through the secure system which uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and no third party can become aware of it during transport on the network.
The buyer's account will be debited when placing an order for the products or services available and for the amount of the products or services sent.
At the buyer's request, he will be sent a paper invoice showing VAT.

Deliveries:

Deliveries are made to the address indicated in the order form which can only be in the agreed geographical area.

Packages are shipped within 1 to 4 days.

Standard delivery: 1 to 3 working days after shipping, depending on carrier times.

The risks are borne by the purchaser from the moment the products have left Vanerra's premises. In the event of damage during transport, a reasoned protest must be made to the carrier within three days of delivery.
Delivery times are given for information purposes only; if these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed.

Vanerra is not responsible for the disappearance of packages after official deposit recorded by the carrier. Once your package is declared delivered, our responsibility is no longer incurred. No refund will be made in this case.

For deliveries to a relay point, the package must be opened and checked before signature.

After validation by customer signature, no complaints will be possible.

Guarantee :

For any complaints about your order, please contact customer service by email contact.vanerra@gmail.com within a maximum of 72 hours upon receipt of your package.

The guarantee no longer applies beyond 14 days from the date of receipt. All products supplied by the seller benefit from the legal guarantee provided for by articles 1641 et seq. of the Civil Code.

In the event of non-conformity of a product sold, it may be returned to Vanerra who will take it back, exchange it or reimburse it in exchange for a credit on the vanerra.com site.

Any complaints for an order will be impossible beyond 60 days from the invoice date.

Responsibility :

The seller, in the online sales process, is only bound by an obligation of means; it cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, interruption of service, or other unintentional problems.

Intellectual property :

All elements of the “Vanerra” site are and remain the intellectual and exclusive property of Vanerra.

No one is authorized to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, elements of the site, whether software, visual or sound.
Any simple or hypertext link is strictly prohibited without the written consent of Vanerra.

The Vanerra brand as well as all figurative or non-figurative brands and more generally all other brands, illustrations, images and logos appearing on the Goods, their accessories and their packaging, whether registered or not, are and will remain the property exclusive to Vanerra. Any total or partial reproduction, modification or use of these brands, illustrations, images and logos, for any reason and on any medium whatsoever, without the express prior consent of Vanerra, is strictly prohibited. The same applies to any combination or conjunction with any other brand, symbol, logo and more generally any distinctive sign intended to form a composite logo. The same applies to any copyright, design, model and patent which are the property of Vanerra. In addition, all designs and visuals of which Vanerra is the author, that is to say, created by Vanerra internally, can only be used exclusively by Vanerra.

Personal data:

In accordance with the law relating to data processing, files and freedoms of January 6, 1978, personal information relating to buyers may be subject to automated processing.

Vanerra reserves the right to collect information about buyers, including by using cookies, and, if it wishes, to transmit the information collected to commercial partners.
Buyers may object to the disclosure of their contact details by notifying Vanerra. Likewise, users have a right of access and rectification of data concerning them, in accordance with the law of January 6, 1978.
The automated processing of information, including the management of e-mail addresses of users of the site, was the subject of a declaration to the CNIL on 03/28/2012 registered under number 1576466.

Archiving – Proof:

Vanerra will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.

Vanerra's computerized records will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

Litigation :

These conditions of online sale are subject to French law.

In the event of a dispute, jurisdiction is assigned to the competent courts of Draguignan, notwithstanding multiple defendants or warranty claims.
